The transitional arrangements for the Town and Country Planning (Environmental Impact Assessment) Regulations 2017 mean that, depending on the circumstances, either the existing (2011 EIA Regulations, as amended) or new Regulations may apply – or a combination of the two.
It will be important for both developers and local planning authorities to understand which Regulations apply to a project and to keep track of this as projects go through the planning system.
